These Terms of Trade apply to all users who subscribe to, or pay fees for, access to the CONTRACKED platform.

CONTRACKED is a division of Cutting Edge Consultancy Limited (the Parent Company). All references to “CONTRACKED”, “we”, “us”, or “our” refer to Cutting Edge Consultancy Limited trading as CONTRACKED.

1.1 CONTRACKED provides a subscription-based digital platform that enables Contractors, Facilities, and Requestors to connect and exchange information.

1.2 CONTRACKED does not:

• Negotiate contracts between users
• Charge finder’s fees or commissions
• Supervise, manage, or perform work
• Guarantee work outcomes or performance

2.1 Contractors and Facilities subscribe on either:

• A monthly subscription (auto-renewing), or
• An annual subscription (fixed term)

2.2 Guests may submit requests on a per-request fee basis.

2.3 Current pricing is as advised at the time of subscription or request.

3.1 Invoices are issued monthly in advance unless otherwise agreed.

3.2 Payment is required by direct credit to the nominated bank account.

3.3 Subscriptions renew automatically unless cancelled in accordance with these Terms.

3.4 No refunds are provided for part months or unused periods.

4.1 Monthly subscriptions may be cancelled with one month’s written notice.

4.2 Annual subscriptions remain in force until the end of the agreed term.

4.3 Failure to pay fees may result in suspension or termination of access.

5.1 CONTRACKED may change pricing at its discretion.

5.2 Monthly subscribers will receive at least two months’ notice of price changes.

5.3 Annual subscribers will receive any changes at renewal.

6.1 To the fullest extent permitted by New Zealand law, CONTRACKED’s total liability arising from these Terms is limited to the fees paid by the user in the preceding 12 months.

6.2 CONTRACKED is not liable for:

• Loss of work or opportunity
• Disputes between users
• Quality, safety, or performance of work
• Commercial negotiations or outcomes
• 
  

These Terms are governed by New Zealand law. Any disputes are subject to the exclusive jurisdiction of the New Zealand courts.

CONTRACKED may update these Terms from time to time. Updated Terms will be published on the platform.

These Platform Terms of Use govern how users access and use the CONTRACKED (APP) platform.

1.1 CONTRACKED is an information and coordination platform.

1.2 CONTRACKED enables:

• Contractors to present qualification and vetting information
• Facilities and Requestors to identify potential Contractors

1.3 CONTRACKED is neutral and does not act for any party.

The platform recognises the following users:

• Contractors
• Facilities
• Requestors
• Guests

Each user must only use the platform in accordance with their role.

3.1 “Approved” means that CONTRACKED has reviewed information provided by the user for accuracy and validity as far as reasonably practicable at the time of review.

3.2 Approval:

• Is not a guarantee, endorsement, or certification
• Does not replace site inductions or checks
• Does not remove user responsibilities

4.1 CONTRACKED may withdraw approval or suspend access where:

• False or misleading information is provided
• Required fees are unpaid
• A contractor enters liquidation
• A contractor is investigated by WorkSafe for safety breaches
• Required documents expire and are not updated

4.2 Document expiry notifications are issued two months and one month prior to expiry.

5.1 CONTRACKED stores:

• Police vetting confirmation
• Health and safety pre-qualification status
• Business information including:
  
  • Business names and trading names
  • Business locations
  • Logos and branding
  • Business contact names
  • Phone numbers
  • Email addresses
  • Websites

5.2 The business information collected is information that a business would ordinarily make publicly available.

5.3 CONTRACKED does not store:

• Full H&S documentation
• Personal identity information beyond what is necessary

5.4 Users acknowledge and agree that:

• Information they provide may be shared with other platform users for the purpose of contractor–facility matching
• They are responsible for ensuring the information they provide does not breach the Privacy Act 2020 or any other applicable privacy obligations
• They are comfortable that the information supplied is appropriate for sharing in a professional, business-to-business context

5.5 Users control their own data via password-protected access.

5.6 Facilities and Requestors may view and download information provided by Contractors.

6.1 Users remain fully responsible for:

• Work quality and safety
• Contract terms and pricing
• Site inductions and supervision

6.2 CONTRACKED is not responsible for:

• Shoddy or unsafe work
• Contract disputes
• Payment disputes
• Commercial negotiations

6.3 CONTRACKED does not seek or accept finder’s fees, commissions, or rewards.

7.1 Contractors and Facilities may provide logos for platform display.

7.2 Logos are displayed only for platform matching and identification.

7.3 Marketing or promotional use of logos requires written permission.

Users must not:

• Misuse platform data
• Provide false information
• Attempt unauthorised access
• Use the platform for unlawful purposes

CONTRACKED may terminate access for serious or repeated breaches of these Terms.

These Terms are governed by New Zealand law and subject to the New Zealand courts.

CONTRACKED does not provide contracting services, supervise work, or guarantee outcomes.

We collect information that is necessary to operate the platform and provide our services.

This may include:

• Business name and trading name
• Business locations
• Logos and branding
• Business contact names
• Phone numbers
• Email addresses
• Websites

This is information that a business would ordinarily make publicly available.

We may collect and store:

• Police vetting confirmation
• Health and safety pre-qualification status

We do not store full health and safety documentation or unnecessary personal identity information.

We may collect:

• Login credentials (passwords are user-created and stored securely)
• Subscription status and billing records

We use collected information to:

• Operate and maintain the CONTRACKED platform
• Match Contractors with Facilities or Requestors
• Verify subscription and approval status
• Communicate about accounts, renewals, and document expiry
• Meet legal and regulatory obligations

4.1 Information provided by users may be shared with other platform users where reasonably necessary to facilitate contractor–facility matching.

4.2 Users acknowledge and agree that:

• Information supplied is provided in a professional, business-to-business context
• They are responsible for ensuring the information they provide does not breach the Privacy Act 2020 or any other applicable privacy obligations

4.3 CONTRACKED does not sell personal information.

Users must:

• Ensure information they upload is accurate and current
• Only provide information they are authorised to share
• Ensure information supplied is appropriate for sharing with other businesses

CONTRACKED is not responsible for information uploaded by users that breaches third-party rights or privacy obligations.

6.1 CONTRACKED takes reasonable steps to protect information from loss, misuse, unauthorised access, or disclosure.

6.2 Information is stored in secure, password-protected systems.

6.3 Access to information is restricted to authorised users.

7.1 Users may access and update their own information through the platform.

7.2 Requests for access or correction may also be made by contacting CONTRACKED.

8.1 Information is retained only for as long as necessary to:

• Provide platform services
• Meet legal or regulatory requirements
• Resolve disputes or enforce agreements

8.2 Information may be securely deleted when no longer required.

CONTRACKED may use cookies or analytics tools to improve platform performance and user experience.

Users may disable cookies via their browser settings.

CONTRACKED may update this Privacy Policy from time to time.

The current version will always be available on the CONTRACKED website.

If a user believes their privacy has been breached, they should contact CONTRACKED in the first instance.

If unresolved, complaints may be directed to the Office of the Privacy Commissioner.
